2027 Purchase Agreement & Terms of Sale

By placing an order with us, you acknowledge that you have read, understood, and agreed to the following terms. These policies exist to protect our breeding program, our animals, and to ensure expectations are clear before purchase.

Order Fulfillment & Shipping Window

• Our typical hatching egg shipping season is April - October, weather dependent. We are located on Long Island, NY, Zone 7b.
• Orders are fulfilled in the order they are received, unless a later ship date is requested by the buyer.
• We generally reach out approximately one week prior to an expected ship window.
• We cannot predict exact ship dates. Weather, holidays, molting, broody birds, and natural fluctuations in laying may cause delays.
• Buyers are responsible for determining whether our shipping season works for their climate. We can move an order back, but we cannot move an order forward.

Order Combinations & Shipping

• A maximum of 2 dozen standard-size chicken eggs can be shipped per shipment. Larger orders may require multiple shipments.
• Hatching eggs and dry goods must be ordered separately.
• We strongly recommend ordering chicken and quail eggs separately. Their laying timelines do not always match, and combining them may delay fulfillment.
• Hatching egg shipping is not included at checkout. Shipping is paid prior to shipment through PayPal, Venmo, or Zelle.
• We typically ship Monday - Wednesday, weather permitting.

Order Communication

We use separate emails for separate needs:

• Active orders: OPEN_ORDER.VAGABOND_CULTURE@YAHOO.COM
• Shipping: We will contact you from a separate shipping email and/or by text.
• When emailing about an order, include the name associated with the order and order number in the subject line.
• A valid phone number and monitored email are required. We will not ship hatching eggs without confirmation.
• Social media is not an accepted form of communication for active orders. Any agreement, change, delay, transfer, or other order-related information discussed on social media must be followed up through the active-order email. If it is not documented there, we cannot guarantee it will be reflected on your order.
• If we cannot reach you when eggs are available, we will move to the next order. After three separate unanswered attempts, your order may be moved to the end of the season or canceled without refund.
• We do not provide shipping estimates. If you have dates you cannot receive your order, notify us through the active-order email.

Egg Color & Natural Variation

• Egg color, bloom, and speckling naturally vary throughout the laying cycle and season. Lighter eggs do not indicate poor genetics or future laying performance.
• Photos represent what our genetics can and do produce and do not guarantee the exact appearance of your shipment.
• In mixed project pens, the egg a chick hatches from does not guarantee the exact egg color, bloom, or speckling the resulting hen will produce.

Shipping, Delays & Damage

• Once a package leaves our care, shipping delays, handling issues, and damage are the responsibility of the carrier.
• We do not refund or replace eggs damaged during shipping.
• Visible damage must be photographed immediately and all packaging retained for a carrier claim.

Hatch Rates, Fertility & Risk

• Hatching eggs are always a risk.
• We do not guarantee hatch rates.
• We do guarantee fertility, which is monitored throughout the season.
• Fertility and hatchability are not the same. A poor hatch rate alone does not mean the eggs were infertile.
• By purchasing hatching eggs, you accept the risks associated with shipping and incubation.

Chicks, Straight Run & Roosters

• Chicks are sold straight run unless specifically stated otherwise. Male-to-female ratios are not guaranteed.
• Any resulting roosters are the buyer's responsibility.
• We do not accept birds back under any circumstances due to biosecurity.

Refunds, Cancellations & Changes

• All sales are final.
• We do not offer refunds or replacements on hatching egg or live animal orders.
• Requests for a delay or store credit may be made prior to fulfillment and are at our discretion.
• Orders may be canceled, but cancellation does not result in a refund.
• Orders may be transferred to another person. The new buyer assumes the existing order, queue position, and terms.

Orders We Cannot Fulfill

• If we cannot fulfill your order by the end of our shipping season, you will be offered first priority the following season or another available product.
• If our flock is unexpectedly unable to continue and your order cannot be fulfilled at all, a refund will be issued.

Final Acknowledgment

By placing an order, you confirm that you understand:

• Hatching eggs carry inherent risk

• Shipping dates and hatch rates are not guaranteed

• Shipping delays and damage are outside our control

• Egg color varies naturally

• Active-order communication must be documented by email

• All sales are final
